Prabhu Bank guarantees Rabi's release with a sum of Rs 22.5 million

Rabi Lamichhane, the chairman of the Rastriya Swatantra Party (RSP), has been granted bail by three courts in different matters involving cooperative fraud. His release was ordered by the Katmandu District Court in the Swarnalakshmi Cooperative fraud case in Kalimati, the Rupandehi District Court in the Supreme Cooperative fraud case in Butwal, and the Kaski District Court in the Suryadarshan Cooperative fraud case in Pokhara.

The first bail amount for Lamichhane in the Suryadarshan Cooperative fraud case was Rs 6.5 million. The bail order was granted on January 9 by Judge Nitij Rai of the Kaski District Court, who cited proof that cooperative funds had been repeatedly placed into Lamichhane’s account via cheques and then taken out. Lamichhane was released after producing a bank guarantee from Prabhu Bank in accordance with the decision.

Lamichhane was permitted to appear before the Kathmandu District Court willingly, despite the fact that it was anticipated that he would be detained again as soon as he was released from Pokhara. He appeared before the court three days later.

Additionally, Lamichhane was granted Rs 6 million in bail by the Kathmandu District Court on January 15. The order was given by a single bench of Judge Madhav Prasad Adhikari, and Prabhu Bank once more supplied the required guarantee for the sum.

Lamichhane appeared in the Rupandehi District Court in relation to the Supreme Cooperative fraud case located in Butwal after obtaining his parole in Kathmandu. Judge Prahlad Kumar Yogi granted him release on Rs 10 million bail on Sunday. The court observed that although there was insufficient proof of guilt, the evidence that was presented aroused enough suspicion to call for additional research.

According to Section 74 of the Criminal Procedure Code 2074 BS, Lamichhane had to provide an unconditional bank guarantee of Rs 10 million, cash bail, or property bail in order to be released from detention pending trial. His release was made possible by the guarantee Prabhu Bank gave for this sum as well.

With Prabhu Bank acting as the guarantor in each of the three cases—Kaski, Kathmandu, and Rupandehi—Lamichhane has posted a total bail amount of Rs 22.5 million.

Lamichhane, meantime, has petitioned the Pokhara High Court to overturn the Rs 6.5 million bail that the Kaski District Court had set. He has denied any role in the purported misappropriation of money from the Surya Darshan Cooperative in Pokhara, asserting that he is the victim of a plot to harm his name.
